Terms and Conditions of Use
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “student”), and Tristar Academy, a Maryland-based real estate education provider (“Company,” “we,” “us,” or “our”), concerning your access to and use of the website www.mytristaracademy.com
as well as any related platforms, courses, products, services, or other offerings. By accessing the site, enrolling in any course, or utilizing our services, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms and Conditions.
If you do not agree with all of these Terms and Conditions, you are expressly prohibited from using the site or enrolling in courses and must discontinue use immediately.
1. AGREEMENT TO TERMS
By accessing the Tristar Academy website and participating in any of our offerings, you represent and warrant that you have the legal capacity and authority to enter into these Terms. You acknowledge that these Terms are binding and enforceable under applicable law. You further acknowledge that Tristar Academy operates solely within the United States and only accepts students domiciled in the United States. Use of our site or enrollment in our courses from any jurisdiction outside the United States is strictly prohibited and void where unlawful.
We reserve the exclusive right to amend, modify, or supplement these Terms at any time, with or without notice, and such changes shall be deemed effective immediately upon posting to the website. Continued use of the site or participation in courses following the posting of revised Terms shall be construed as your acceptance of such modifications. It is your responsibility to review these Terms periodically.
2. INTELLECTUAL PROPERTY
Unless otherwise indicated, the site, its content, our courses, and all materials provided to students—including but not limited to text, outlines, presentations, digital files, study guides, videos, Zoom sessions, and any other intellectual property (collectively, “Content”)—are the proprietary property of Tristar Academy, its licensors, or its content suppliers.
You are granted a limited, non-transferable, non-exclusive license to access and use the Content solely for personal, non-commercial educational purposes during your course enrollment period. This license does not transfer any rights of ownership.
You shall not copy, reproduce, distribute, transmit, display, sell, license, reverse engineer, modify, publish, or otherwise exploit any portion of the Content without the express written consent of Tristar Academy. Any unauthorized use will be considered a material breach of these Terms and may result in immediate termination of access, civil liability, and potential legal action.
3. USER REPRESENTATIONS
By using the site or enrolling in courses, you represent and warrant that:
a. All information provided upon registration is true, accurate, current, and complete.
b. You will maintain the accuracy of such information and promptly update it as necessary.
c. You are at least 18 years of age and meet eligibility requirements established by the Maryland Real Estate Commission or other applicable regulatory body.
d. You will not use the site or services for any unlawful purpose or in violation of any applicable federal, state, or local law.
e. You are solely responsible for ensuring compliance with your licensing jurisdiction, including but not limited to continuing education deadlines, renewal requirements, and exam eligibility.
If any information provided is found to be false, inaccurate, outdated, or incomplete, we reserve the right to suspend or terminate your enrollment and deny all current or future use of the site and services.
4. USER REGISTRATION
Enrollment in any Tristar Academy course requires completion of the registration process, including payment of all required fees and submission of accurate identifying information. As part of registration, you will be required to provide a valid government-issued identification for verification purposes prior to the issuance of certificates of completion.
You are responsible for maintaining the confidentiality of your login credentials and account access. Any activity that occurs under your account will be deemed to have been conducted by you. Tristar Academy shall not be liable for any loss or damage arising from your failure to secure your account credentials.
5. MARKETPLACE OFFERINGS
All courses, bundles, and programs displayed on our site constitute “Marketplace Offerings.” Tristar Academy reserves the right to modify, suspend, discontinue, or substitute any course or offering at its sole discretion and without liability to you.
While we endeavor to ensure that Marketplace Offerings are accurate, current, and complete, we make no representations or warranties that such offerings will always be available, error-free, or suitable for every individual. Course schedules, instructors, and materials may be altered at any time without prior notice to comply with updated Maryland Higher Education Commission regulations, Maryland Real Estate Commission rules, or other state requirements.
By purchasing a Marketplace Offering, you acknowledge that enrollment provides eligibility to complete the course but does not guarantee passing grades, licensure, or success on any state-administered examination, including but not limited to PSI Services LLC examinations.
6. PURCHASES AND PAYMENT
By placing an order for any Marketplace Offering, you agree to pay all applicable fees, including taxes, shipping charges for textbooks, and any other costs displayed at the time of purchase. Payments must be made in U.S. dollars through the payment methods accepted on the site.
You agree to provide current, complete, and accurate billing information for all purchases. Should your payment method fail, you remain responsible for any amounts due and agree to promptly provide an alternative form of payment.
Tristar Academy reserves the right to refuse or cancel any order placed for any Marketplace Offering in the event of clerical error, fraud, suspected misuse, or unauthorized activity.
7. REFUNDS POLICY
All refund requests must be made in writing to Tristar Academy via email to [email protected]
. The following policies apply to all courses and services:
7.1 Prelicensing Courses (Salesperson and Broker)
a. Refund requests submitted prior to the start of the course may be eligible for a refund, less a non-refundable administrative fee of twenty dollars ($20).
b. No refunds shall be granted once a course has commenced, regardless of attendance or participation, except where required by applicable per the refund schedule outlined within the Enrollment Forms.
c. No refunds shall be granted once textbooks, course manuals, or digital access credentials have been issued, mailed, or made available to the student.
d. If a student fails to upload valid identification for certificate release, this shall not constitute grounds for a refund.
e. Students who do not complete the course within the allotted one-year timeframe shall forfeit all tuition paid.
f. Students who do not complete the state licensing exam within the allotted one-year timeframe shall have to retake the prelicensing course applicate per state regulations.
7.2 Self-Paced Courses
a. Access to self-paced courses is activated immediately upon issuance of login credentials.
b. Due to the nature of digital access, no refunds will be provided once a student has completed 50% of more of the course.
7.3 Continuing Education Courses
a. Refund requests submitted at least seventy-two (72) hours prior to the scheduled start of a live course may be eligible for a refund.
b. No refunds will be issued for requests received within seventy-two (72) hours of the scheduled start time.
c. No refunds will be granted once a course has started or once a certificate of completion has been issued.
d. For on-demand or self-paced continuing education, no refunds will be provided once access is granted.
7.4 Course Rescheduling and Transfers
a. Students may request to reschedule a live course to another available date if the request is made prior to the original course start time.
b. Rescheduling requests submitted after the course start time may be subject to an additional transfer fee, determined at Tristar Academy’s sole discretion.
c. Rescheduled courses must be taken within twelve (12) months of the original registration date.
7.5 Retake Policy
a. Prelicensing students who fail both attempts of the final exam must re-enroll in the course at their own expense.
b. A discounted re-enrollment fee may be offered at the discretion of Tristar Academy only for courses offered by Tristar Academy. Courses offered by other partners such as; Colibri, are not subject to a discounted re-enrollment fee.
7.6 General Refund Limitations
a. Refunds will be processed only to the original payment method used at registration.
b. Shipping charges, credit card processing fees, and applicable taxes are non-refundable.
c. Failure to attend, log in, or otherwise participate in a course does not entitle a student to a refund.
d. Refunds will not be issued for dissatisfaction with instructor style, teaching methods, or course content, provided the course was delivered as described.
e. Students acknowledge and accept that passing the course does not guarantee passing the PSI exam or licensure by any state regulatory body.
8. PROHIBITED ACTIVITIES
You agree not to engage in any activity that violates these Terms or applicable law, including but not limited to:
a. Circumventing or attempting to circumvent the security of the site or learning platform.
b. Sharing login credentials, access codes, or Zoom links with any other person.
c. Recording, reproducing, or redistributing live or pre-recorded course content.
d. Engaging in disruptive, harassing, or abusive conduct during any class session.
e. Using the site for any purpose other than lawful participation in educational offerings.
f. Impersonating another student or misrepresenting your identity for the purpose of gaining course credit or certification.
Violations may result in immediate dismissal from courses without refund, forfeiture of credit, and potential legal action.
9. USER GENERATED CONTRIBUTIONS
Students may have the opportunity to submit questions, participate in discussions, or otherwise contribute content during live or online classes (“Contributions”). By providing Contributions, you represent that:
a. You own or have the necessary licenses to provide such Contributions.
b. Your Contributions will not infringe upon any third-party intellectual property rights.
c. Your Contributions will not contain unlawful, defamatory, obscene, harassing, or otherwise objectionable material.
We reserve the right to remove, edit, or reject Contributions at our sole discretion and without notice.
10. CONTRIBUTION LICENSE
By submitting Contributions, you grant Tristar Academy a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, distribute, display, and otherwise exploit such Contributions in connection with our business operations and educational services. This license includes the right to incorporate Contributions into course content, study materials, marketing, or other commercial use.
You waive all moral rights in your Contributions and represent that no third-party rights will be violated by such use.
11. GUIDELINES FOR REVIEWS
If the site permits reviews, testimonials, or evaluations, you agree that:
a. Your review will be based on your actual, firsthand experience with Tristar Academy’s offerings.
b. Your review will not contain offensive, defamatory, or unlawful language.
c. Your review will not be used to promote other businesses, services, or products.
d. Tristar Academy reserves the right to remove or edit reviews that are false, misleading, or inconsistent with these Terms.
By submitting a review, you grant Tristar Academy the right to use, publish, and reproduce such review for marketing and promotional purposes without compensation.
12. SUBMISSIONS
Any questions, comments, feedback, suggestions, or other submissions provided to Tristar Academy, whether solicited or unsolicited, shall become the sole property of Tristar Academy. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of such submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
You hereby waive any rights to such submissions and acknowledge that Tristar Academy shall not be obligated to maintain submissions in confidence or to respond to them.
13. THIRD-PARTY WEBSITES AND CONTENT
The site may contain links to third-party websites, resources, or content that are not owned, controlled, or operated by Tristar Academy. Such links are provided solely as a convenience to you. We do not endorse, warrant, or assume responsibility for the accuracy, availability, legality, or content of any third-party sites or resources.
You acknowledge and agree that Tristar Academy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on such third-party websites or content. Your use of third-party websites is subject to the terms and conditions of those websites, which you are solely responsible for reviewing and complying with.
14. ADVERTISERS
The site may allow third-party advertisers to display advertisements or promotions. The relationship between you and any such advertisers is solely between you and the advertiser. Tristar Academy does not endorse, guarantee, or assume liability for any products or services advertised.
You agree that Tristar Academy shall not be liable for any loss or damage of any kind incurred as a result of your dealings with advertisers or participation in their promotions.
15. SITE MANAGEMENT
Tristar Academy reserves the right, but not the obligation, to:
a. Monitor the site for violations of these Terms.
b. Take appropriate legal action against any user who, in our sole discretion, violates the law or these Terms, including without limitation, reporting such user to law enforcement authorities.
c. Restrict, deny access to, or disable any user account at any time without prior notice or liability.
d. Remove or otherwise disable files or content that are excessive in size or are burdensome to our systems.
e. Manage the site in a manner designed to protect our rights, property, and operations and to facilitate the proper functioning of the educational services.
16. PRIVACY POLICY
Your use of the site and enrollment in our courses is also governed by our Privacy Policy, which is incorporated herein by reference. By using the site, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy.
We collect and store personal information, including but not limited to your name, email address, government-issued identification, course completion records, and licensing information, for the purpose of providing educational services and reporting to regulatory commissions such as the Maryland Real Estate Commission and the Virginia Real Estate Board.
You acknowledge and agree that we may disclose personal information where required by law or to comply with requests of state licensing bodies, including but not limited to the Maryland Higher Education Commission and the Maryland Real Estate Commission.
17. TERM AND TERMINATION
These Terms shall remain in full force and effect while you use the site or are enrolled in any course. Without limiting any other provision of these Terms, we reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the site and services (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation breach of any representation, warranty, or covenant contained in these Terms or violation of any applicable law or regulation.
We may terminate your account, enrollment, and access to any course at any time, without warning, in our sole discretion. Upon termination, your right to use the site and services will immediately cease, and you may not be entitled to any refund, credit, or other compensation.
Termination of your enrollment shall not affect obligations that by their nature are intended to survive termination, including but not limited to intellectual property provisions, limitations of liability, indemnification, and dispute resolution.
18. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the site or any course at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our site.
We will not be liable to you or any third party for any modification, suspension, or discontinuance of the site or services.
We cannot guarantee the site and services will be available at all times. We may experience hardware, software, or other problems, or we may need to perform maintenance related to the site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the site or services at any time without notice to you.
You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the site or services during any downtime or discontinuance. Nothing in these Terms will be construed to obligate us to maintain and support the site or services or to supply any corrections, updates, or releases in connection therewith.
19. GOVERNING LAW
These Terms and your use of the site and services shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. All disputes, claims, or causes of action arising under or relating to these Terms, the site, or any Marketplace Offerings shall be resolved exclusively within the state or federal courts located in Montgomery County, Maryland. You hereby irrevocably consent to the jurisdiction of such courts and waive any objection to venue or inconvenient forum.
20. DISPUTE RESOLUTION
In the event of any dispute arising out of or relating to these Terms or your use of the site or services, you agree to first attempt resolution by submitting a written notice of dispute to Tristar Academy. If the parties cannot resolve the matter within thirty (30) days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
The arbitration shall take place in Montgomery County, Maryland, before a single arbitrator. The arbitrator shall have exclusive authority to resolve all disputes, including but not limited to any claim that all or any part of these Terms is unenforceable.
Notwithstanding the foregoing, Tristar Academy retains the right to pursue injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property, proprietary information, or contractual rights. You agree that arbitration shall be conducted on an individual basis and not as part of any class, collective, or representative action.
21. CORRECTIONS
The site may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, or other information. Tristar Academy reserves the right to correct any errors, inaccuracies, or omissions at any time without prior notice.
We do not warrant that the information contained on the site or in any Marketplace Offering is free of errors, current, or complete. You agree that reliance on such information is at your own risk, and Tristar Academy shall not be liable for any damages arising from reliance on incorrect or outdated content.
22. DISCLAIMER
The site and all Marketplace Offerings are provided on an “as is” and “as available” basis. Tristar Academy disclaims all warranties, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that courses, materials, or services will meet your expectations, that participation will guarantee licensure, that examinations will be passed, or that credits will always be accepted by your licensing authority. Passing the course does not guarantee passing the PSI exam or obtaining a license.
Tristar Academy is not responsible for interruptions, errors, or failures beyond its reasonable control, including but not limited to student technology issues, internet failures, or delays caused by third parties such as shipping carriers, PSI Services LLC, or state licensing commissions.
23. LIMITATIONS OF LIABILITY
To the fullest extent permitted by law, Tristar Academy, its directors, officers, employees, instructors, and affiliates shall not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, lost revenues, loss of data, or other damages arising out of or related to your use of the site, courses, or services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to these Terms, the site, or any Marketplace Offering shall not exceed the total amount paid by you to Tristar Academy for the course or service giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages; however, you agree that in any event, Tristar Academy’s liability shall be limited to the maximum extent permitted by Maryland law.
24. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Tristar Academy, its affiliates, instructors, employees, officers, directors, and agents from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:
a. Your use of the site, courses, or services.
b. Your breach of these Terms.
c. Any misrepresentation or violation of law by you.
d. Infringement of the rights of a third party, including but not limited to intellectual property rights or privacy rights, arising from your conduct.
Tristar Academy reserves the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to fully cooperate with us in asserting any available defenses.
25. USER DATA
We will maintain certain data that you transmit to the site for the purpose of managing the site, tracking your course progress, reporting continuing education credits, and issuing certificates of completion. Although we perform routine backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the site.
You agree that Tristar Academy shall have no liability to you for any loss or corruption of data, and you hereby waive any right of action against us arising from any such loss or corruption. You further acknowledge that data provided to state regulatory agencies, such as the Maryland Real Estate Commission or Virginia Real Estate Board, is transmitted for compliance purposes and that Tristar Academy is not responsible for delays or errors occurring once data has been submitted.
26. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
By visiting the site, sending emails, or using the services, you consent to receive electronic communications. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically, whether via email or posted on the site, satisfy any legal requirement that such communication be in writing.
You hereby consent to the use of electronic signatures, contracts, orders, and other records, as well as to the electronic delivery of notices, policies, and records of transactions initiated or completed by Tristar Academy or via the site. You waive any rights or requirements under laws, regulations, or other rules in any jurisdiction which require an original signature, delivery, or retention of non-electronic records, or to payments or credits by means other than electronic.
27. USERS AND RESIDENTS
The site and services are controlled and offered by Tristar Academy from facilities within the United States. Access to the site or enrollment in courses is intended solely for individuals located in the United States. Tristar Academy makes no representation that the site or services are appropriate or available in other jurisdictions, and access from locations outside the United States is prohibited.
28. MISCELLANEOUS
These Terms and Conditions, together with any policies or operating rules posted by Tristar Academy on the site or in respect to the services, constitute the entire agreement and understanding between you and us. Failure by us to enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
You may not assign or transfer these Terms, by operation of law or otherwise, without prior written consent from Tristar Academy. Any attempted assignment in violation of this provision shall be null and void. Tristar Academy may freely assign or transfer these Terms without restriction. These Terms shall be binding upon and inure to the benefit of the parties, their successors, and permitted assigns.
